{"id":16622,"date":"2026-07-29T18:45:02","date_gmt":"2026-07-29T18:45:02","guid":{"rendered":"https:\/\/tgia.sosimplestudio.co\/?p=16622"},"modified":"2026-07-29T18:45:02","modified_gmt":"2026-07-29T18:45:02","slug":"thai-general-insurance-association-foils-staged-insurance-fraud-claim-attempted-14-million-baht-claim-finds-suspicious-overlapping-insurance-across-28-policies","status":"publish","type":"post","link":"https:\/\/tgia.sosimplestudio.co\/en\/thai-general-insurance-association-foils-staged-insurance-fraud-claim-attempted-14-million-baht-claim-finds-suspicious-overlapping-insurance-across-28-policies\/","title":{"rendered":"Thai General Insurance Association Foils Staged Insurance Fraud Claim, Attempted 14-Million-Baht Claim, Finds Suspicious Overlapping Insurance across 28 Policies"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Dr. Somporn Suebthawilkul, President of the Thai General Insurance Association, said that regarding news reports of a group of people engaging in insurance fraud behavior, staging a car accident in which a person was killed, and filing an insurance claim for more than 14 million baht, with the incident occurring at Ban Na Bua-Charoensin, That Subdistrict, Wanon Niwat District, Sakon Nakhon Province, on the evening of 10 February, Sakon Nakhon police arrested suspects who staged a disguised murder of a 32-year-old man, making it look like a vehicle accident in which he fell from the back of a pickup truck before two other vehicles ran over his body, causing death. The insurance companies found irregularities in the behavior that may fall within, or signal warning signs of, insurance fraud. Regarding the staged 3-vehicle collision accident, it was found that the vehicles involved had compulsory motor insurance (Por Ror Bor insurance) and voluntary motor insurance totaling 28 policies from 15 companies, with combined coverage of more than 14 million baht, which appeared as major news continuously in various media.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Regarding this event, the insurance business sector found issues that were irregular and behavior that may fall within fraud, or signal warning signs of insurance fraud. It began on 21 February 2025, when a person authorized by the deceased&#8217;s heirs submitted documents claiming compensation from various insurance companies in Mukdahan Province area, through the Road Accident Victims Protection Co., Ltd., Mukdahan Branch, which acts on behalf of various insurance companies in receiving claims. The Road Accident Victims Protection Co., Ltd., Mukdahan Branch, then checked the information of the vehicle involved in the accident, and found it was insured under multiple compulsory motor insurance policies, so it recorded the claim notification, but the matter is still under fact-finding investigation, awaiting additional documents from the claimant, for further consideration of claims payment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Subsequently, coordination was made with other insurance companies that had additionally underwritten the vehicle in question, to cross-check information. From the joint data analysis between the insurance companies and the Road Accident Victims Protection Co., Ltd., it was found that this behavior was irregular and may fall within fraud, since multiple policies were taken out within a similar timeframe and just days before the incident, and claims were filed in multiple areas. In addition, power of attorney was granted to other persons to act on the claimant&#8217;s behalf. This led to a joint investigation, and coordination with the OIC and local police, resulting in an investigation process that led to the arrest of several co-conspirators on charges of jointly murdering the accident victim who died in the incident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From this incident, had the non-life insurance business sector not detected behavior falling within insurance fraud, the insurance companies underwriting this case would have had to pay claims for all 3 vehicles insured, from all 15 companies, totaling 14,100,000 baht, with the following details:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1. Compulsory motor insurance policies (Por Ror Bor), 22 policies, with death coverage of 500,000 baht per policy, totaling 11,000,000 baht.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2. Voluntary motor insurance policies, 6 policies, with death coverage of 500,000 baht per policy, totaling 3,000,000 baht.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3. Personal accident insurance (Ror Yor 01), 1 policy, with coverage of 100,000 baht.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Insurance companies must proceed with paying claims from vehicle accidents promptly, to help remedy and assist victims and their heirs, with claims payment for Por Ror Bor insurance policies required within 7 days, and voluntary insurance policies within 15 days after receiving complete documentation. However, for this incident, the insurance companies requested additional documents to support consideration of the claim, and it is expected that this may fall within insurance fraud, which is clearly an exclusion under the insurance policy. Coordination was therefore made with local police, and the police have issued a letter notifying the OIC to order a delay in paying claims for this case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, in cases where an insurance company finds that fraud or insurance fraud has occurred, such as a person fraudulently claiming benefits under an insurance policy, or presenting false evidence in a claim, this constitutes an offense under Section 108\/4 of the Non-Life Insurance Act B.E. 2535, punishable by imprisonment not exceeding 3 years, or a fine not exceeding 300,000 baht, or both, or if claims are made fraudulently, the company is not liable for claims arising from fraud or deceit which the policyholder or a person acting on the policyholder&#8217;s behalf committed in order to receive benefits under the insurance policy, and the insurance company may exercise the right to immediately terminate the insurance policy, without refunding the premium.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The President of the Thai General Insurance Association added that in the past, the insurance business has found cases of insurance fraud and has taken legal action, such as the famous case of a wealthy man who cut off his finger to claim insurance in the past, in which it was found through investigation that he had planned to take out personal accident insurance (PA) with several companies, totaling tens of millions of baht, staging car collisions, or pouring hot water on both legs, to create a story of an accident in hopes of an insurance payout, among other examples.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This also includes cases where groups of people travel around buying multiple insurance policies from several companies. This kind of behavior is not considered managing one&#8217;s own risk, but rather seeking improper benefit, and groups of people who think and act in this way are considered to be committing insurance fraud. The Association therefore wishes to warn people who engage in this kind of behavior that insurance provides coverage only for policyholders who exercise their rights in good faith. If it can be proven that a person acted in bad faith in taking out insurance, this is an illegal act and they will certainly not receive claims payment under the insurance contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In such cases, the Association asks consumers to recognize that &#8220;insurance is a tool for risk management, not a tool for seeking improper benefit.&#8221; Whatever level of risk a person has, they should purchase insurance appropriate and consistent with their own risk. Purchasing large amounts of insurance and then seeking improper benefit is considered a fraudulent and deceitful act. &#8220;The principle of insurance is to provide coverage for honest members of the public, giving them a guarantee to help mitigate loss and financial damage, so that victims receive compensation, using insurance as a tool to take care of themselves in times of misfortune so they can continue to live.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Finally, the Thai General Insurance Association asks for the public&#8217;s cooperation: if fraudulent behavior is observed, it can be reported to the Thai General Insurance Association or the relevant insurance company. Use insurance correctly and honestly, to protect your own rights and maintain the stability of the insurance industry.
